1. INFORMATION FOR USERS
This document regulates the general terms and conditions applicable to the purchase of tourist services and hotel reservations made through the website https://www.30degreeshotels.com, in accordance with the provisions of Law 34/2002, on Information Society Services and Electronic Commerce, and Law 3/2014, which modifies the Consolidated Text of the General Law for the Defense of Consumers and Users (Royal Legislative Decree 1/2007).
Contracting any of the services offered implies full and unreserved acceptance of these conditions.
2. ACCEPTANCE OF THE CONDITIONS
Acceptance of this document implies that the client:
a) He/She has read, understands and comprehends its content.
b) He/She is a person with sufficient legal capacity to enter into a contract.
c) He/She expressly assumes and accepts all obligations arising from it.
These conditions will have indefinite validity These terms and conditions will apply to all bookings made through the website. The provider reserves the right to modify them unilaterally, without affecting bookings made prior to the modification.
3. IDENTITY OF THE PARTIES
In accordance with the provisions of current legislation, and in particular with the provisions of the Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, the accommodation and hotel booking services offered through the website https://www.30degreeshotels.com They are provided by the entities that own or manage the establishments that operate under the trademark 30degrees Hotels, and which are detailed below:
GESTIHOTELS COSTA CÁLIDA, SL., with NIF B66570441, owner and/or manager of Hotel Dos Playas, Hotel Playa Sol and Bahia Hotel.
EHOGA HOTEL MANAGEMENT, SL., with NIF B67508606, owner and/or manager of Binivell Park Apartments.
OLIHER, SL., with NIF B58465857, owner and/or manager of Hotel Spain.
FRINGIAN, SL., with NIF B66451402, owner and/or manager of Apartments Beatrix.
From now on, all of them collectively referred to as the service provider.
The booking and contracting process is carried out through a online booking engine provided by an external technology provider (WITBOOKING), which acts exclusively as technical intermediation platform, without intervening in the provision of the accommodation service or assuming any responsibility for it.
4. SUBJECT OF THE CONTRACT
These conditions regulate the contractual relationship between the provider and the client from the moment the latter accepts the conditions during the online booking process, the contract being perfected in accordance with articles 1.258 and 1.262 of the Civil Code.
5. SERVICES OFFERED
The provider offers tourist accommodation services and hotel reservations, including any additional services that may be added during the contracting process.
6. PRICES
The prices shown on the website are final prices, including taxes, except for typographical errors.
The Tourist tax not included and must be paid directly at the establishment.
For bookings made from outside Spain, the customer assumes any additional bank charges. The provider is not responsible for these costs.
Prices may vary in real time and will always be displayed before booking confirmation.
7. LANGUAGE
The hiring process can be carried out in Spanish, English, or the languages available on the Witbooking platform.
8. CONTRACTING PROCESS
The booking process is done entirely online and includes:
Hotel selection and dates.
Choice of accommodation type.
Selection of additional services (if applicable).
Guest data entry.
Confirmation and payment.
Automatic sending of the Booking Confirmation to the email address provided.
The hiring process is carried out through a online booking engine technologically managed by WITBOOKING, The user is redirected to this platform during the booking process. Use of this platform does not alter the contractual relationship, which is established exclusively between the client and the provider of the corresponding accommodation service.
9. PAYMENT METHODS
Payment will be made through credit or debit card through a secure payment platform.
The provider is not responsible for errors resulting from incorrect data entered by the customer.
10. CANCELLATION AND NO SHOW
The cancellation policy will depend on the selected rate:
Standard rates
Free cancellation until 24 hours before of the arrival date.
Cancellation outside the deadline or no-show: 100% charge of the first night or reservation, according to specific conditions.
Prepaid / Non-Refundable Rates
The total amount may be charged at any time after making the reservation.
It does not allow cancellation or refund.
NO SHOW: 100% charge of the reservation.
VAT included.
The tourist tax will be paid directly at the hotel.
11. RIGHT OF WITHDRAWAL
In accordance with current regulations, the right of withdrawal will not apply to accommodation services for specific dates, without prejudice to the provisions of the booking confirmation.
12. CLAIMS
Customers can submit complaints by contacting the relevant establishment directly via email, telephone, or in person.
13. JURISDICTION
The parties expressly submit to the Courts and Tribunals of Barcelona capital, unless otherwise mandated by law.
14. APPLICABLE LEGISLATION
These conditions are governed by the current Spanish legislation.
